Terms and Conditions
1. Acceptance of our Terms of Use and Advertising
1.1) This agreement is between You Let Direct ‘us’ and the Landlord ‘you’.
1.2) The terms and conditions for this service relate only to the You Let Direct advertising only service. Separate terms and conditions will apply for those using other services offered by You Let Direct.
1.3) By entering into this agreement, you are confirming you have read the terms and conditions, and you agree to them.
1.4) You agree for You Let Direct to publish your advert on the internet and on our partner site for a maximum of 6 weeks.
1.5) Our marketing fee is £39.00 (plus v.a.t.) All fees will be paid in advance of the rental property being listed on the major UK property portals and are non-refundable.
1.6) Any amendments wishing to be made once the listing has been accepted and approved by the landlord, including the additon or removal of any images, will incur a one off administration fee of £10.00 (inc vat).
2. Your responsibilities
2.1) You have the legal right to let the property.
2.2) The description you provide is true and accurate, and is not misleading in any form. You Let Direct does not take any responsibility for the accuracy of the information or images supplied and cannot be liable.
2.3) The Landlord will pay the advert fee in full, before the advert will be published.
2.4) You have obtained permission from the owner of any photographs used, You Let Direct will not be held liable for any breach of copyright.
2.5) If you have a contract with a letting agent you confirm that you have independently checked the contract, in regards to the agents future claim for commission in relation to you letting your property on the internet. You Let Direct will not be liable, if later found you are legally bound to pay another Letting Agents commission.
2.6) Only one property may appear per advert.
2.7) The Landlord will arrange and complete all viewings for the advertised property.
2.8) The Landlord will inform You Let Direct via email once the property has been let, within three working days.
2.9) You Let Direct will not be liable for any computer virus transmitted through the site. It is the advertiser responsibility to use suitable antivirus software.
2.10) You Let Direct will have no involvement in the negotiation between advertiser and tenant or there representative as part of the You Let Direct service
2.11) The Landlord understands that You Let Direct does not set the marketing price, conduct viewings or negotiate between you and potential tenant.
2.12) The Landlord agrees to have a current Landlords Gas Safety and Certificate and Energy Performance Certificate and will give tenants a copy on or before the start date of the tenancy.
2.13) The Landlord has no formal contract with You Let Direct other than the time period of their advertising term.
2.14) The Landlord agrees to upload at least one image of their property.
3. You Let Direct Responsibilities
3.1) You Let Direct will advertise your property details within two working days on our partner sites. We reserve the right to amend or change your advert and amend or change which partner sites or property portals your advert will appear on. Working days will be deemed Monday to Friday except for bank holidays.
Publication on our partner sites may be subject to alteration. The external sites used to advertise your property may vary from time to time and we reserve the right to amend at any time during your advertising period.
3.2) You Let Direct will take off all properties which have let, within two working days of receiving an email from the Landlord, confirming the advertised property is let.
3.3) All properties will be advertised on the internet for a 6 week period.
3.4) We will, to our best efforts, ensure that You Let Direct is available at all times. We reserve the right to take the site offline for essential upgrades or maintenance. This will be done without prior notice.
3.5) You Let Direct will not disclose your personal details to any third party without your permission, unless we are requested to do so legally. We will only publish the details that you select as part of your listing. We will not email you regarding further promotional and marketing offers.
3.6) You Let Direct shall be entitled to suspend any services without notice or liability where the Landlord has used the service in an unlawful manner or has failed to comply with the terms of use and advertisement.
3.7) You Let Direct is entitled to suspend/terminate the services in full at any time, by giving all advertisers 24hrs notice.
3.8) You Let Direct reserve the right to alter our terms and conditions subject to giving an advertiser 7 days written notice.
4. Limitation of Liability
4.1) You Let Direct will under no circumstances be deemed liable for negligence, breach of contract, loss of data or profit, failure to perform, misrepresentation or otherwise, for a direct or indirect loss or damage suffered by you as a result of use or association with our website.
4.2) Landlord’s fully accept that You Let Direct’s liability will under no condition or circumstance ever exceed the advertising fee received.
